These Terms of Service govern your use of The Monthly Mail Club website and your purchase of products from The Monthly Mail Club.

The terms “The Monthly Mail Club,” “The Daily Tea,” “we,” “us,” and “our” refer to the business operating this store. The terms “you” and “your” refer to the person accessing the website or placing an order.

By visiting this website, placing an order, or using our services, you agree to these Terms of Service and the policies incorporated into them.

  1. ELIGIBILITY

You must be legally capable of entering into a binding agreement in your place of residence to make a purchase.

If you place an order on behalf of another person, you represent that you have permission to provide their information and arrange delivery to them.

You agree to provide current, complete, and accurate order, contact, payment, and shipping information.

  1. OUR PRODUCTS

The Monthly Mail Club produces physical, dated planners designed around individual Jewish months, along with occasional accessories or add-on products.

Each planner edition may contain layouts, content, features, colors, materials, or extras created specifically for that month. Future editions are not guaranteed to be identical to previous editions.

We make reasonable efforts to display product colors, dimensions, photographs, and descriptions accurately. Actual colors and appearance may vary slightly due to lighting, photography, printing, materials, and screen settings.

  1. PRODUCT AVAILABILITY

Products may be printed or stocked in limited quantities.

Placing an item in your cart does not reserve it. An item is not secured until checkout is completed and the order is accepted.

We may limit quantities, discontinue products, correct inventory errors, or decline an order when reasonably necessary.

If we cannot fulfill an accepted order, we will contact you and provide an appropriate remedy.

  1. ORDERS AND ORDER ACCEPTANCE

Submitting an order is an offer to purchase the selected products under the prices and terms displayed at checkout.

An automated order confirmation acknowledges that we received your order. We reserve the right to review, accept, decline, or cancel an order for reasons including suspected fraud, payment failure, inventory errors, pricing errors, address problems, or misuse of the website.

If we cancel an order before fulfillment, we will refund any amount collected for the canceled item unless a different remedy is agreed upon.

Please review your order carefully before submitting it.

  1. PRICES, TAXES, AND PAYMENT

Prices are displayed in U.S. dollars unless stated otherwise.

Applicable taxes and any other charges will be displayed at checkout before payment.

We may change prices for future purchases or subscription renewals. A price change does not retroactively alter a completed purchase.

You represent that you are authorized to use the payment method submitted with your order.

  1. PURCHASE OPTIONS

The Monthly Mail Club may offer three purchase options:

ONE-TIME PURCHASE

A one-time purchase covers only the selected edition. It does not renew automatically.

MONTHLY SUBSCRIPTION

A monthly subscription renews and charges automatically once each month until canceled. Each successful charge covers the next edition.

You may cancel future renewals through your customer account or by emailing inbox@thedailytea.org before the next charge is processed.

PREPAID YEAR

A prepaid year is one upfront purchase for twelve monthly editions mailed separately. It does not automatically renew for another year.

  1. FINAL SALE

All purchases are final sale because the planners are dated, printed in limited quantities, and prepared for a specific Jewish month.

We do not accept returns or exchanges and do not issue refunds for change of mind, accidental purchases, unused planners, missed planning time, or orders that have already been charged and prepared.

Monthly subscribers may cancel future renewal charges. Canceling does not refund an edition that has already been charged.

The prepaid yearly option is final sale and cannot be canceled or refunded after purchase.

Nothing in these Terms limits a legal right or remedy that cannot lawfully be excluded.

  1. SHIPPING AND DELIVERY

We currently ship within the United States.

Shipping dates and carrier delivery estimates are not guaranteed. Shabbos and Yom Tov schedules, weather, carrier delays, address problems, and circumstances outside our reasonable control may affect delivery.

You are responsible for providing an accurate shipping address and keeping it updated for future subscription or prepaid-year deliveries.

  1. PROMOTIONS AND DISCOUNTS

Promotions, discounts, gifts, and add-on offers may have separate eligibility requirements, start dates, end dates, quantity limits, and combination restrictions.

Unless stated otherwise, offers are available while supplies last and may not be combined with other product discounts.

We may correct or cancel a promotion that was published or applied in error. If an error affects an order already placed, we will contact the customer before making a material change.

  1. ACCOUNTS AND SUBSCRIPTION MANAGEMENT

You may be able to create or access a customer account to view orders and manage subscription information.

You are responsible for maintaining the confidentiality of your account access and for activity conducted through your account.

Please contact us promptly if you believe your account or payment information has been used without authorization.

  1. ACCEPTABLE USE

You may use this website only for lawful personal or household shopping purposes.

You may not:

• Use the website for fraud or unlawful activity
• Interfere with the security or proper operation of the website
• Introduce viruses, malicious code, or harmful technology
• Attempt to gain unauthorized access to accounts, systems, or customer information
• Scrape, copy, reproduce, resell, or commercially exploit website content without permission
• Misrepresent your identity or payment authority
• Use the website in a manner that infringes another person’s rights

We may limit or terminate access when we reasonably believe these Terms have been violated.

  1. INTELLECTUAL PROPERTY

The Monthly Mail Club and The Daily Tea names, planner designs, written content, photographs, graphics, branding, page layouts, downloadable materials, and other original content are owned by us or used with permission.

They may not be copied, reproduced, distributed, modified, resold, or used commercially without prior written permission.

Purchasing a planner gives you ownership of that physical copy. It does not transfer the copyright or commercial reproduction rights to its design or content.

  1. THIRD-PARTY SERVICES

Our store is powered by Shopify and may use third-party providers for payment processing, subscription management, shipping, analytics, marketing, and other business functions.

Your use of certain third-party features may also be governed by the provider’s terms and privacy policies.

We are not responsible for the independent content, availability, security, or practices of websites that we do not control.

If you choose to receive promotional emails or text messages, you may unsubscribe using the method included in the message.

Unsubscribing from promotional marketing does not prevent us from sending transactional communications relating to an order, payment, subscription, cancellation, or shipment.

  1. ERRORS AND CORRECTIONS

Website content may occasionally contain typographical mistakes, pricing errors, inventory errors, or incomplete information.

We may correct errors and update information when discovered.

If a material error affects an order you placed, we will contact you and provide the available options before making a change that increases the amount you owe.

  1. DISCLAIMER

To the fullest extent permitted by applicable law, the website and its content are provided on an “as available” basis.

We do not guarantee that the website will always be uninterrupted, error-free, or available at every moment.

Nothing on the website constitutes medical, legal, financial, or other professional advice.

Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, The Monthly Mail Club and The Daily Tea will not be liable for indirect, incidental, special, or consequential damages arising from the use of the website or products.

Our total liability relating to a particular purchase will not exceed the amount paid for the product giving rise to the claim, except where applicable law requires otherwise.

Nothing in these Terms excludes liability that cannot legally be excluded.

  1. INDEMNIFICATION

To the extent permitted by law, you agree to be responsible for losses or claims arising directly from your unlawful use of the website, violation of these Terms, or infringement of another person’s rights.

  1. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect. The affected provision will be limited or modified only to the extent necessary to make it enforceable.

  1. NO WAIVER

Our decision not to enforce a provision on one occasion does not waive our right to enforce it later.

  1. GOVERNING LAW

These Terms are governed by the laws applicable in the State of New York, without regard to conflict-of-law principles.

Nothing in this section deprives a consumer of protections that apply under the mandatory laws of their place of residence.

  1. CHANGES TO THESE TERMS

We may update these Terms to reflect changes to our products, services, business practices, or legal obligations.

The updated version will be posted with a new “Last updated” date. Changes apply prospectively unless applicable law requires otherwise.
